Welcome to the Terms and Conditions of Carina v/d Kloet. Here you will find all the agreements regarding 1-on-1 sessions, workshops, and packages in vitality, healthy nutrition, breathing, and styling. Transparency and clarity are at the core of our services.

2. Applicability

  1. These terms and conditions apply to all agreements and services provided by Carina v/d Kloet, including:
    • Individual sessions.
    • Workshops for consumers and businesses.
    • Programs combining multiple services in personal styling, healthy nutrition, breathing, lifestyle, and vitality.
  2. Deviations from these terms are only valid if agreed upon in writing.
  3. These terms and conditions are provided at the time of entering into an agreement and can be reviewed on [website link].

3. Services and Delivery

Carina v/d Kloet offers personalized and tailored services, including:

Personal Styling:
Color analysis, style analysis, communication through clothing, wardrobe advice, and personal shopping.

Healthy Nutrition and Lifestyle:
Nutritional advice and coaching on healthy habits, and lifestyle coaching..

Breathing:
Breathing coaching

Mental Vitality:
Vitality advice.

Programs:
Combinations of the above services in a comprehensive solution.

Services are provided on the agreed date, time and location as agreed between Carina v/d Kloet and the client.

Services may take place either in person at a location or online via digital communication tools, provided this has been agreed upon in advance with the client.

If a service takes place at the client’s location, the client is responsible for providing a suitable and safe space.

The advice and guidance provided by Carina v/d Kloet are aimed at supporting healthy nutrition, lifestyle, styling, vitality and personal development. This guidance does not replace medical advice, diagnosis or treatment by a physician or other medical professional.

If the client has medical complaints, uses medication or has health concerns, the client is advised to consult a general practitioner or medical specialist.

Guidance may take place in consultation with a physician or specialist if the client explicitly gives permission.

For guidance in the field of nutrition, Carina v/d Kloet works as a weight consultant in accordance with the guidelines of the Dutch Association of Weight Consultants (Beroepsvereniging Gewichtsconsulenten Nederland – BGN).

The advice is aimed at healthy nutrition and lifestyle and does not replace medical treatment or advice from a physician or dietitian.

For services delivered on-site, the client must provide a suitable space.

4. Prices and Payment

Service rates are communicated and agreed upon in advance unless clearly stated on the website or in other written communication.

Payment must be made within 14 days of the invoice date, unless otherwise agreed.

For individual sessions, programs, workshops and coaching, an invoice may be sent in advance. Payment must be completed no later than the day of the appointment unless otherwise agreed.

If payment is not received after a second reminder, Carina v/d Kloet reserves the right to:

Charge statutory interest;

Charge administrative or collection costs in accordance with legal regulations.

Carina v/d Kloet reserves the right to suspend future appointments or services until outstanding invoices have been paid in full.

Rates:

For private clients: including 21% VAT.

For business clients (including self-employed professionals): excluding 21% VAT.

All garments and products provided through Carina v/d Kloet remain the property of Carina v/d Kloet until full payment has been received.

5. Rescheduling and Cancellation

Rescheduling appointments by the client

Rescheduling an appointment must be requested in writing via email to hello@carinavanderkloet.nl.

The appointment is only considered rescheduled once written confirmation has been received.

When an appointment is rescheduled to a new date in mutual agreement with the client, the previously issued invoice remains valid unless explicitly agreed otherwise.

The original invoice date and payment term remain unchanged.

Rescheduling is free of charge provided it is done within the applicable cancellation terms.

If a client arrives late for an appointment, the lost time will not be compensated and the full fee remains payable.

Maximum number of rescheduling attempts

An appointment can be rescheduled a maximum of four times.

For individual sessions, no new appointment will be scheduled after a fifth rescheduling attempt, and the agreement will be terminated.

For programs or multi-session cards (such as a strippenkaart), the following applies:

  • Each individual session can be rescheduled a maximum of four times.
  • In addition, no more than four sessions in total may be rescheduled within the entire program.

If these limits are exceeded, Carina v/d Kloet reserves the right to revise, modify, or terminate the agreement.

Costs in case of program termination

If a single session, program, or workshop is terminated after exceeding the maximum number of rescheduling attempts:

  • Sessions already completed will be fully charged.
  • A (partial) credit invoice will be issued for sessions not yet used.
  • A deduction of €75 will be applied to cover preparation, administration, and reserved time.

If the invoice has already been paid, the refundable amount will be adjusted accordingly.

If the invoice has not yet been paid, an adjusted invoice will be sent, reflecting the cost of the completed sessions plus €75 in processing fees.

Rescheduling appointments by Carina v/d Kloet

Carina v/d Kloet reserves the right to reschedule an appointment in the event of force majeure or when, in mutual consultation with the client, it proves necessary to do so. In such cases, every effort will be made to agree on a suitable new date.

When Carina v/d Kloet reschedules an appointment, the original invoice generally remains valid. If the new appointment date is significantly postponed, a revised payment term can be arranged in consultation.

Cancellation

Cancellations must be submitted by email to hello@carinavanderkloet.nl, stating your name and the scheduled appointment.
Please note: your cancellation is only valid once you have received a confirmation from Carina v/d Kloet.

Individual Sessions, Workshops, and Programs for Consumers:

Personal shopping (shopping together or collecting items)

  • Cancellation is free of charge up to 7 days prior to the appointment (due to preparatory work).
  • Cancellation within 7 days: 50% of the costs will be charged.
  • Cancellation within 48 hours or a no-show: 100% of the costs will be charged.

Workshops:

  • Cancellation is free of charge up to 7 days prior to the workshop (due to preparatory work).
  • Cancellation within 7 days: 50% of the costs will be charged.
  • Cancellation within 48 hours or a no-show: 100% of the costs will be charged.

Coaching and Programs:

  • Cancellation is free of charge up to 48 hours prior to the appointment.
  • Cancellation within 48 hours: 100% of the costs will be charged.

Intake Sessions:

  • Free sessions must be canceled at least 24 hours prior to the scheduled time.
  • For cancellations within 24 hours or a no-show, a future appointment may no longer be offered free of charge.

Workshops and Programs for Businesses:

Cancellations are free of charge up to 14 days prior to the workshop or package.

Cancellation within 14 days: 50% of the costs will be charged.

Cancellation within 7 days: 100% of the costs will be charged.

A no-show will result in 100% of the costs being charged.

Refunds:

If a service or package is cancelled by Carina v/d Kloet, the full amount will be refunded within 14 days.

Force Majeure:

6. Changes to agreement

In the event of changes to the content, duration, or scheduling of a programme, Carina v/d Kloet reserves the right to adjust the agreement and/or rate. These changes will always be discussed with the client in advance and confirmed in writing.

7. Liability, Health and Personal Responsibility

Carina v/d Kloet performs services to the best of her knowledge and expertise.

The services are based on an obligation of effort, meaning no specific results can be guaranteed.

The client remains responsible for following advice and for decisions made based on the guidance.

The client must provide accurate and complete information regarding health, medication use, allergies or medical treatments.

Carina v/d Kloet cannot be held liable for consequences resulting from incorrect or incomplete information.

Carina v/d Kloet is not liable for indirect damage including loss of income or business interruption.

Liability is limited to the invoice amount of the relevant service.

Liability only applies in cases of intent or gross negligence.

Participation in coaching and guidance takes place at the client’s own responsibility.

If the client has doubts about their health, a physician or specialist should be consulted beforehand.

The client acknowledges that the services provided by Carina v/d Kloet are educational and coaching-based in nature and are not intended as medical, psychological or therapeutic treatment.

    8. Complaints Procedure

    Complaints must be submitted in writing within 14 days after the service or package has been delivered.

    Carina v/d Kloet will respond to complaints within 14 days of receipt.

    If the complaint is deemed justified, an appropriate solution will be offered in consultation with the client.

    Submitting a complaint does not suspend the payment obligation.

      9. Privacy and Data Protection

      Carina v/d Kloet processes personal data in accordance with the General Data Protection Regulation (GDPR).

      Personal data is used exclusively for the provision of services and communication with the client.

        10. Force Majeure

        In the event of force majeure, including but not limited to illness, incapacity for work, technical failures, government measures, pandemics, natural disasters or other circumstances beyond the reasonable control of Carina v/d Kloet, Carina v/d Kloet has the right to suspend or cancel the agreement without liability.

        In such cases a suitable solution will be sought, such as rescheduling the service.

        11. Intellectual Property

        All materials, analyses, and advice provided during the services and packages remain the property of Carina v/d Kloet.

        It is not permitted to copy, share, or commercially use these materials without written permission.

          12. Applicable Law and Disputes

          These terms and conditions are governed by Dutch law.

          Disputes will preferably be resolved amicably.

          If this is not possible, disputes will be submitted to the competent court in Amsterdam.

            13. Final Provisions

            If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

            Carina v/d Kloet reserves the right to amend these terms and conditions.
